1.4 Parent Managed Platform

Todemy is designed as a parent managed platform for early childhood development.

  1. The Service is intended for children aged 2 to 7 years under supervision
  2. All accounts must be created and controlled by a Parent or Guardian
  3. Children are not permitted to independently access, register, or manage the Service

1.5 Applicability

These Terms apply to:

  1. Parents and legal guardians
  2. Authorized adult users such as educators or institutions
  3. Website visitors and prospective users

1.6 Binding Effect

By accessing or using any part of the Service, you agree to be bound by these Terms and all applicable policies, including the Privacy Policy.

1.7 Consistency with Platform Functionality

These Terms reflect the actual operation of the Service, including:

  1. Use of device permissions such as camera, microphone, and location where enabled
  2. Use of AI powered tools and automated features
  3. Storage of certain user data in secure systems
  4. Parent controlled management of child access and features

Todemy operates as a parent managed platform. By creating an account or using the Service:

  1. You confirm that you are providing consent on behalf of the child
  2. You accept full responsibility for the child's use of the Service
  3. You acknowledge that children are not permitted to provide consent independently

2.6 Ongoing Acceptance

Your continued use of the Service constitutes ongoing acceptance of these Terms, including any updates or modifications made from time to time.

2.7 Additional Terms

Certain features of the Service, including AI tools, subscriptions, community features, or third party integrations, may be subject to additional terms or disclosures. Such terms shall form part of these Terms where applicable.

2.8 Reliance on User Declarations

Todemy relies on the information and declarations provided by users at the time of registration. You acknowledge that we do not independently verify parental status or authority in all cases and accept responsibility for the accuracy of the information provided.

Section 3: Eligibility and Account Registration

Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract to create and manage an account on the Service.

3.2 Parent Managed Access

Todemy is a parent managed platform. Children are not permitted to create accounts or access the Service independently. All child usage must occur through an account created and controlled by a Parent or Guardian.

3.3 Account Registration

To access core features of the Service, you are required to create an Account. You agree to provide accurate, complete, and current information during registration and to keep such information updated.

3.4 Account Credentials

You are responsible for maintaining the confidentiality and security of your account credentials, including passwords, OTP access, and linked devices. You are responsible for all activities that occur under your Account.

3.5 Responsibility for Use

You accept full responsibility for all activities conducted through your Account, including any actions taken by a child using a Child Profile linked to your Account.

3.6 No Independent Child Accounts

Children may not:

  1. Register for accounts
  2. Provide personal information independently
  3. Access adult features
  4. Enter into any agreements

3.7 Verification and Checks

Todemy may, at its discretion, request verification of identity, age, or authority to act on behalf of a child where reasonably necessary for security, fraud prevention, or compliance purposes.

3.8 Unauthorized Access

You must immediately notify us if you suspect any unauthorized access or misuse of your Account. We are not liable for any loss arising from unauthorized use where reasonable security measures were not maintained by you.

3.9 Account Restrictions

We reserve the right to refuse registration, suspend, or terminate accounts where:

  1. Information provided is false, misleading, or incomplete
  2. There is a risk to child safety or platform integrity
  3. The Service is used in violation of these Terms or applicable law

3.10 Institutional and Partner Use

Where accounts are created by schools, educators, or organizations, the registering individual confirms that they have the authority to act on behalf of that entity and to provide any required consents.

3.11 One Account Policy

You may not create multiple accounts for the same user without authorization or use automated means to create accounts.

Section 4: Child Profiles and Parental Control

Child Profiles and Parental Control

4.1 Creation of Child Profiles

A Parent or Guardian may create one or more Child Profiles within the Service. By doing so, you confirm that you are legally authorized to provide consent and manage data on behalf of the child.

4.2 Parent Responsibility

You are solely responsible for:

  1. Supervising the child's use of the Service
  2. Managing access to features and permissions
  3. Monitoring interactions, including AI and voice features
  4. Ensuring that content accessed is appropriate
  5. You acknowledge that parental consent is provided at the time of account creation or login

4.3 No Independent Child Access

Children are not permitted to:

  1. Create or manage accounts
  2. Access adult only features such as community tools
  3. Enter into transactions or subscriptions
  4. Modify parental controls or account settings

All child access must occur strictly through a Parent controlled Account.

4.4 Use of Child Information

When creating a Child Profile:

  1. You should use minimal necessary information
  2. Use of nicknames is encouraged instead of full legal names
  3. You are responsible for the accuracy of information provided

4.5 Parental Controls

The Service may provide tools that allow Parents to:

  1. Enable or disable features such as AI, voice, or location
  2. Control access to community or interactive features
  3. Manage data visibility and permissions
  4. Review learning progress and activity

You are responsible for properly configuring these controls.

4.6 Feature Restrictions

Certain features are restricted based on safety and age suitability. You agree not to intentionally allow a child to access features intended only for adult users.

4.7 Liability for Child Activity

You accept full responsibility for all activity carried out through Child Profiles linked to your Account, except where such activity results from our failure to implement reasonable security measures.

4.8 Safety and Supervision

You acknowledge that the Service is not a substitute for parental supervision. You must actively supervise children, especially when using AI features, voice interactions, or any interactive tools.

4.9 Data Control by Parent

All data associated with a Child Profile is controlled by the Parent Account. Any requests relating to access, correction, or deletion of such data must be made by the Parent or Guardian.

5.1 Scope of the Service

Todemy provides a parent managed digital platform designed to support early childhood learning and development through interactive, AI assisted, and personalized features.

5.2 Core Features

Depending on availability, user settings, and subscription status, the Service may include:

  1. Interactive learning content and activities for children
  2. Personalized learning journeys and recommendations
  3. Progress tracking, milestones, and insights for parents
  4. Parent dashboard and account management tools
  5. AI powered chatbot and voice interaction features
  6. Health and wellness tools including vaccination tracking and heartbeat measurement
  7. Adult only community and interaction features
  8. Subscription based premium content and features

5.3 AI Powered Features

The Service includes AI powered tools, including chatbot functionality and voice based interactions.

  1. AI responses are generated automatically and may be incomplete, inaccurate, or inappropriate
  2. AI does not provide professional advice of any kind
  3. AI interactions may be stored in internal systems to maintain conversation context and improve functionality
  4. Such storage is limited to Service functionality and is not used for external model training
  5. User data is not used to train external AI models, but may be used internally for contextual responses

You are responsible for supervising all AI interactions involving children.

5.4 Health and Wellness Features

The Service may include health-related features such as vaccination tracking and heartbeat measurement using the device camera.

  1. These features are provided for general informational and wellness purposes only
  2. They are not medical devices and do not provide diagnosis or treatment
  3. Measurements, including heart rate, may be approximate and not clinically accurate

You must consult a qualified healthcare professional for any medical concerns.

5.5 Voice and Audio Features

The Service may use microphone access to enable voice interactions, including AI conversations, text to speech, avatar communication, and counselling related features.

  1. Audio input is processed in real time
  2. Raw audio is not stored by Todemy
  3. Only system level outputs or interaction results may be retained where necessary

5.6 Location Based Features

Certain features may use precise location data.

  1. Location access is optional and controlled by the Parent
  2. Location data is not used for advertising or profiling
  3. It may be enabled or disabled at any time through device settings

5.7 Data Storage and Infrastructure

User data is stored in secure systems, including cloud based databases located outside the user's country.

  1. Data may be stored in systems such as MongoDB hosted in external regions
  2. Data is protected using industry standard security measures
  3. Access is restricted to authorized personnel and service providers

5.8 Third Party Services

The Service may integrate with third party providers, including:

  1. Analytics services such as Firebase
  2. AI providers such as OpenAI, Gemini, and Groq
  3. Infrastructure and storage services such as AWS S3, Redis, and related systems
  4. Communication services such as SendGrid
  5. Payment platforms where applicable

These providers process only the data necessary to perform their functions.

5.9 Feature Availability

Not all features may be available at all times or in all regions. Access may depend on:

  3. Upload, post, transmit, or share any content that is abusive, defamatory, obscene, misleading, hateful, or otherwise inappropriate
  4. Infringe or violate the intellectual property or other rights of any person
  5. Impersonate any person or misrepresent your identity or authority
  6. Attempt to gain unauthorized access to the Service, systems, or accounts
  7. Interfere with or disrupt the operation, security, or integrity of the Service
  8. Reverse engineer, decompile, or attempt to extract source code except where permitted by applicable law
  9. Use automated tools, bots, or scripts in a manner that negatively impacts the Service
  10. Collect, store, or misuse personal data of other users without authorization
  11. Use the Service to market to children or create unauthorized child profiles
  12. Use community features for spam, harassment, or unauthorized commercial activity

You agree to use the Service in a manner that prioritizes the safety and wellbeing of children. Any activity that may put a child at risk is strictly prohibited.

6.4 User Content Responsibility

You are solely responsible for any content you submit, upload, or share through the Service. You must ensure that such content complies with these Terms and applicable law.

6.5 Monitoring and Enforcement

We may monitor usage, review content, and take appropriate action where necessary to:

  1. Enforce these Terms
  2. Protect users, especially children
  3. Prevent misuse, fraud, or illegal activity
  4. Comply with legal obligations

6.6 Consequences of Violation

If you violate this Section, we may, at our discretion:

  2. Suspend or terminate your Account
  3. Restrict access to certain features
  4. Report the matter to relevant authorities where required by law

6.7 No Circumvention

You must not attempt to bypass, disable, or interfere with any security measures, parental controls, or usage restrictions implemented within the Service.

7.3 License to Todemy

By submitting User Content, you grant Todemy a non exclusive, worldwide, royalty free license to use, store, reproduce, display, distribute, and moderate such content solely for the purposes of operating, improving, securing, and enforcing the Service.

7.4 Responsibility for Content

You are solely responsible for your User Content. You agree that:

  1. You have the necessary rights and permissions to share such content
  2. Your content does not violate any law or third party rights
  3. Your content does not harm, exploit, or endanger any child
  4. Your content complies with these Terms

7.5 Prohibited Content

You must not submit or share content that:

  1. Is unlawful, misleading, or fraudulent
  2. Is abusive, offensive, defamatory, or harmful
  3. Violates privacy or intellectual property rights
  4. Promotes harm, exploitation, or unsafe behavior involving children

  2. Remove, restrict, or disable content that violates these Terms

We are not responsible for storing or maintaining User Content indefinitely and may remove or disable access to content at our discretion.

You acknowledge that interactions with other users are at your own risk. Todemy does not guarantee the conduct, accuracy, or reliability of any user.

7.10 Compliance with Law

We may comply with legal obligations related to content moderation, reporting, or data sharing with authorities where required under applicable law.

Section 8: AI Features and Disclaimers

8.1 AI Features

The Service includes artificial intelligence powered tools, including chatbot functionality, voice based interaction systems, avatar based communication, and automated learning assistance.

8.2 AI Providers

These features may be supported by third party AI providers, including OpenAI, Gemini, Groq, and related technologies, which process data only to the extent necessary to provide the Service.

8.3 Nature of AI Outputs

You acknowledge and agree that:

  1. AI generated outputs may be incomplete, inaccurate, or inappropriate
  2. AI responses are generated automatically based on system logic and available data
  3. AI outputs do not represent verified facts or professional advice

8.4 Storage of AI Interactions

Certain AI interactions, including chat responses and conversation context, may be stored in internal systems to:

  1. Maintain continuity of conversations
  2. Generate contextual responses
  3. Improve functionality and safety

Such data is not shared publicly and is used only within the Service.

8.5 No External Training Use

User interactions are not used to train external AI models. Data may be processed internally to support context generation and system performance.

AI Features do not provide:

You must not rely on AI outputs as a substitute for professional guidance.

You are responsible for supervising all interactions between a child and AI Features. You must review outputs and ensure they are appropriate before allowing reliance.

8.8 Appropriate Use

You agree not to use AI Features to:

  1. Generate harmful, unlawful, or inappropriate content
  2. Mislead, impersonate, or deceive others
  3. Create content that may negatively impact children

8.9 System Limitations

We do not guarantee that AI Features will:

  1. Always be accurate, reliable, or suitable
  2. Be free from errors, bias, or unintended outputs
  3. Meet your specific expectations

8.10 Feature Changes

AI Features may be modified, restricted, or discontinued at any time due to technical, safety, or legal considerations.

Section 9: Health and Wellness Disclaimer

9.1 Informational Purpose Only

The Service may include features that allow parents to record, manage, or track health and wellness related information, including vaccination records and general health inputs.

9.2 Heartbeat Measurement Feature

The Service may use the device camera to estimate heart rate.

Todemy is not a medical device and does not provide medical diagnosis, treatment, or clinical services.

9.5 User Responsibility

You are solely responsible for:

  1. Verifying the accuracy of any health related information entered
  2. Making healthcare decisions for yourself or any child
  3. Consulting qualified healthcare professionals where required

9.6 Vaccination Tracking

Vaccination tracking and reminders are based on user provided data.

  1. We do not guarantee completeness or accuracy
  2. Reminders are informational only and may not reflect official schedules

9.7 Emergency Situations

The Service must not be used in emergency situations. In case of a medical emergency, you must contact appropriate emergency services or a qualified healthcare provider immediately.

9.8 Limitation of Reliance

You agree not to rely on the Service as a substitute for professional medical judgment. Use of any health related feature is at your own risk.

9.9 No Warranty

Todemy disclaims any warranty regarding the accuracy, reliability, or suitability of health and wellness data generated or stored within the Service.

Section 10: Subscriptions, Payments, and Billing

10.1 Paid Services

Certain features of the Service may require payment, including subscription plans or one time purchases. All pricing, billing cycles, and included features will be disclosed prior to purchase.

10.2 Subscription Model

Todemy may operate on a freemium model, where basic features are available free of charge and advanced features require a paid subscription.

10.3 Auto Renewal

Subscriptions may renew automatically at the end of each billing cycle unless cancelled before the renewal date. You are responsible for managing and cancelling your subscription in a timely manner through the applicable platform.

10.4 Payment Processing

Payments are processed through third party platforms, including:

  1. Google Play Store
  2. Apple App Store
  3. Authorized payment providers where applicable

You agree to comply with the payment terms and conditions of the respective platform.

10.5 Platform Based Billing

If you subscribe through an app store:

  1. Billing, cancellation, and refunds are governed by that platform's policies
  2. You must manage subscriptions directly through your app store account

10.6 Pricing Changes

We reserve the right to modify pricing for future billing cycles. Where required by applicable law, we will provide prior notice of such changes.

10.7 Free Trials and Promotions

  1. Trials may convert into paid subscriptions unless cancelled before the trial period ends

Subject to these Terms, Todemy grants you a limited, non exclusive, non transferable, and revocable license to access and use the Service for personal, family, or authorized institutional use.

11.3 Restrictions

You agree not to:

  1. Copy, reproduce, distribute, or publicly display any part of the Service without prior written permission
  2. Modify, adapt, translate, or create derivative works based on the Service
  3. Sell, sublicense, rent, or commercially exploit the Service or its content
  4. Use Todemy trademarks, logos, or branding without authorization
  5. Reverse engineer, decompile, or attempt to extract source code except where permitted by applicable law

11.4 User Content Ownership

You retain ownership of any content you submit, upload, or share through the Service. However, by submitting such content, you grant Todemy the rights described in Section 7 to use, store, and process such content for Service operation and improvement.

11.5 AI Generated Content

Content generated through AI Features is provided for use within the Service. Todemy does not guarantee ownership rights over AI generated outputs beyond personal use unless otherwise stated.

11.6 Feedback

If you provide suggestions, ideas, or feedback regarding the Service, you grant Todemy a worldwide, royalty free, perpetual, and irrevocable right to use such feedback for any lawful purpose without obligation to compensate you.

11.7 Third Party Content

The Service may include content provided by third parties. All rights in such content belong to the respective owners, and your use of such content must comply with applicable terms and laws.

11.8 Enforcement

We reserve the right to take appropriate action, including legal action, in response to any violation of intellectual property rights.

Personal data is stored in secure systems, including databases hosted in external regions such as the United States. Data may be stored in infrastructure such as MongoDB and related cloud services.

12.5 Data Security

We implement reasonable technical and organizational measures to protect personal data, including encryption in transit and at rest, access controls, and system monitoring. Data is encrypted both in transit and at rest using industry standard protocols.

12.6 Access to Data

Access to personal data is limited to:

  1. Authorized Todemy personnel for operational purposes
  2. Trusted service providers who process data on our behalf
  3. Legal authorities where required by applicable law

We do not sell personal data or share it for advertising purposes.

12.7 Third Party Services

We may use third party services for analytics, infrastructure, communication, and AI functionality, including Firebase, OpenAI, Gemini, Groq, Redis, AWS S3, and SendGrid. These providers process only the data necessary to perform their services.

12.8 AI Data Handling

AI interaction data may be stored to maintain context and improve functionality. Such data is not used to train external AI models and is not publicly shared.

12.9 Data Retention

We retain personal data only for as long as necessary for operational, legal, or security purposes. Data deletion may be subject to technical limitations and system architecture constraints.

  1. Some data may be retained in a restricted or inactive form after deletion requests
  2. Data may be stored in backups or logs for a limited period

We reserve the right to suspend, restrict, or terminate your access to the Service, in whole or in part, at any time where reasonably necessary.

13.2 Grounds for Action

  1. You violate these Terms
  2. Your use of the Service poses a risk to child safety, security, or platform integrity
  3. There is suspected fraud, misuse, or unauthorized activity
  4. Payment obligations are not fulfilled or are reversed
  5. We are required to do so by applicable law or regulatory authority
  6. The Service or any part of it is discontinued

13.3 User Initiated Termination

You may stop using the Service at any time. You may also request account deletion in accordance with Section 12.

13.4 Effect of Termination

Upon suspension or termination:

  1. Your right to access and use the Service will cease
  2. Access to features, subscriptions, and data may be restricted or removed
  3. Any outstanding payment obligations will remain due
